Vale Wayne Preedy:
WPI legacy lives on
With deep sympathy and sadness, we inform you that our client, Mr Wayne Preedy,
passed away unexpectedly on Saturday 25 January 2020.
He leaves behind his wife Nicky, and his three children, Tom, James and Georgia.
We’ve had the pleasure of working with Wayne since 2012. His case now stands as a leading authority on whole person impairment (WPI) combination under the Return to Work Act.
It was a significant journey for him and his case is now his legacy.
In our last update on 19 November 2019, we advised of the judgment of Deputy President Judge Calligeros of the South Australian Employment Tribunal (SAET)
Just prior to Christmas, RTWSA appealed the decision and the matter was listed for a further
SAET Full Bench appeal, to be heard on 28 July 2020.
RTWSA has been notified of Mr Preedy’s passing and is in the process of taking advice about whether it will pursue the appeal against his estate. As soon as we have an update we will let you know.
In the meantime, we pay our respects to Wayne who was one of our favourite clients and who over the last seven years became our good friend. We will miss him and his good cheer.

News Flash – Preedy v RTWSA – Combination of Whole Person Impairment
His Honour Deputy President Judge Calligeros handed down his decision on 19 November 2019 in Preedy v RTWSA [2019] SAET 228.
His Honour found that Mr Preedy’s injuries arose from the same cause and as such his whole person impairment should be combined under the RTW Act.
This decision is significant and will potentially increase the number of workers who will meet the 30% threshold and may significantly increase the monetary payments for economic loss lump sum payments under section 56 of the RTW Act.
